Mosman Local Environmental Plan 2012
Mosman Local Environmental Plan (LEP) 2012 was finalised and approved by the Minister for Planning and Infrastructure in late 2011, and published on the NSW Legislation Website on 9 December 2011. It came into effect on 1 February 2012, and consists of a written instrument and maps.
The Mosman LEP 2012 provides the statutory framework for planning, development and building within the Mosman local government area. The LEP allocates land for specific purposes through zoning, and controls the development of this land through development standards, planning controls and other planning provisions, such as those to conserve local heritage and protect sensitive land. The LEP guides planning decisions and manages the way land is used in Mosman, reflecting the Council’s long-established residential development strategy .
From time to time, amendments are made to Mosman LEP 2012, either by the NSW Department of Planning and Environment with amendments to the Standard Instrument (i.e. a State-wide mandated template upon which the LEP is based), or by Council by way of a Planning Proposal. To ensure you are referring to the current version of the LEP you must access it via the NSW legislation website. The Department’s LEPs Online tracker website provides a list of all past and current Planning Proposals throughout NSW, including in Mosman.
Mosman Development Control Plans
Development control plans (DCPs) supplement the provisions of LEPs with more detailed planning and design guidelines. Council has prepared and adopted three zoned-based DCPs to support Mosman LEP 2012. These DCPs represent a consolidation of all previous DCPs which applied in Mosman prior to 2012. The DCPs are:
- Mosman Residential Development Control Plan 2012 – applies to all residential zoned land
- Mosman Business Centres Development Control Plan 2012 – applies to all business zoned land, and private recreation zoned land at The Spit
- Mosman Open Space and Instructure Development Control Plan 2012 – applies to all other zones
The DCPs were adopted by Council on 6 March 2012, and came into force on 29 March 2012. From time to time, amendments are made to the DCPs by Council. The most current versions of the DCPs can be viewed here. The most relevant DCP should be referred to when considering development.
Other local plans and policies also apply in Mosman to guide planning and development, and meet the needs of existing and future generations. These include:

Mosman’s growing population will generate demands for new public facilities as well as having the potential to diminish the existing population’s enjoyment and standards of new public facilities. As such, Council has adopted the Mosman Section 94A Development Contributions Plan 2016, which commenced on 22 December 2016, to enable the collection of monetary contributions for the purpose of augmenting existing public facilities and providing new public facilities.
The plan applies to most land in Mosman, including all residential and all business zoned land. The levy rate is set out in the plan. Proposed works that would be funded by contributions under the plan include:
- the upgrade of sportsfields, swim centre and playgrounds,
- implementation of active transport plans,
- bushland restoration, and
- accessibility works.
