Council has secured a further three year exclusion from the Housing Code of the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 for Mosman’s foreshore slopes.
The exclusion applies to properties within Mosman’s Scenic Protection Area, that is land below the 60m contour, and comes following extensive campaigning by Council of the NSW Government.
The previous exemption was due to expire on 30 November 2018 and would have allowed new dwellings and significant alterations to existing dwellings to be built without the need to submit a development application. This would have left the foreshore slopes vulnerable to development that had no consideration of Council’s policies to maintain the existing landscape, consider submissions from the community and to protect neighbouring properties from view loss, privacy loss and overshadowing.
While the exemption ensures the protection of the foreshore slopes until 2021, Council will continue its campaign of lobbying the State Government in an attempt to secure a definitive solution.
